Legislative and Regulatory Reform Act

Key Benefits
Enable a greater number of reforms to be delivered by Regulatory Reform Order (RRO), by removing some of the restrictions and constraints in the Regulatory Reform Act 2001. Proposals for achieving this include:

Extending the scope of RRO powers to more effectively deliver non-controversial better regulation proposals, including simplification.

Enabling the implementation of uncontroversial Law Commission recommendations, including those that amend the common law.

Providing a power to sub-delegate, i.e. provide for rule-making powers in an RRO.

Removing the current restriction on using an RRO to amend legislation less than 2 years' old, or provisions which have been amended in the previous 2 years.

Enabling an RRO to be used to remove or reduce burdens on a Minister or government department to facilitate public sector reform and modernisation.

Contains provisions to make the proposed new risk-based Regulatory Compliance Code statutory, and to define the extent of its effect.

The public consultation on the Bill ran from 20th July to 12th October. An analysis and summary of responses will be placed on the Better Regulation Executive website within three months of the close of consultation.
