COMPENSATION BILL

KEY MEASURES

  • The Government is committed to tackling the compensation culture, resisting invalid claims but improving the compensation system for those who have a valid claim.
  • It will introduce whatever legislation may prove to be necessary to address these issues. This may, for example include clarification of the existing common law on negligence to make clear that there is no liability in negligence for untoward incidents that could not be avoided by taking reasonable care or exercising reasonable skill. We are investigating whether it could also include the regulation of claims farmers.

A wide-ranging programme of work is being taken forward to tackle issues relating to the compensation culture. Consideration will be given in the context of that work to any aspects where legislation would assist in addressing the issues involved.
