CORPORATE MANSLAUGHTER BILL [DRAFT]

KEY BENEFITS

  • Creates new offence of corporate manslaughter
  • Will make it easier for companies who have shown little or no regard for the safety of their workers or members of the public to be prosecuted for a specific and serious criminal offence
  • This is not about new standards. No new regulatory burdens will be placed companies, and those who already take their obligations under health and safety requirements seriously have nothing to fear
  • This is about corporate liability. The proposals will not target the criminal liability of individual directors. But where an individual is directly to blame, prosecutions will remain possible under existing law
  • This will deliver a manifesto commitment and is an important part of the Government's commitment to deliver clear laws and put victims at the heart of the criminal justice system


TERRITORIAL EXTENT

  • The Bill will apply to England and Wales
